What is a IRS FORENSIC AUDIT and what are the benefits?

A IRS forensic audit is applying accounting skills to tracking and collecting IRS evidence during the investigation of IRS civil and/or criminal tax issues.

The benefits of a IRS forensic audit by tracking and collecting IRS evidence are similar for IRS civil and/or criminal tax issues.  This is because criminal tax allegations require willful intent and civil tax does not.

For example if you have been accused of tax evasion, the government’s position will be that you willfully intended to violate a law you knew and understood.  However, you may have had no willful intent to violate a law and believed what you were doing was within the law. 

IRS forensic audits seek to uncover the evidence that reaches willful intent or lack of willful intent by examining IRS evidence, tracking and collecting additional evidence to explain any irregularities.  Examining IRS evidence such as IRS forms, documents, computer codes, the IRS computer system, IRS master files (IMF), administrative files and examination files are critical in order to determine what evidence needs to be collected. 

IRS forensic auditing aims at a legal determination of whether tax avoidance or tax evasion actually occurred.
